Memorandum of Understanding between the Directorate General for the Information Society of the European Commission and the State Committee for Communications and Informatisation in Ukraine

concerning the development of the Information Society

1. The Directorate General for the Information Society of the European Commission and the State Committee for Communications and Informatisation of Ukraine, herein after referred to as "The Parties",

- Taking into account:

 Articles 30, 51 and 66 of the Agreement on Partnership and Cooperation between Ukraine and EU, which came into force on March 1, 1998,

 The Common strategy of the EU concerning Ukraine accepted during Helsinki Summit of the European Union (December, 1999),

 EU Presidency Work Plan on Ukraine.

- Considering:

 The Protocol of Intentions between the State Committee of Communication and Informatisation of Ukraine and Directorate General XIII of the European Commission signed on July 8, 1999 in Brussels,

 The National Program of Informatisation of Ukraine adopted by the Parliament of Ukraine in 1998.

Hereby agree to co-operate with the objective of developing the Information Society in Ukraine with high priority.

2. The Parties recognize the importance of the Information Society for the development of an efficient market economy and for the provision of opportunities of quality employment. This requires appropriate education in schools and other educational establishments, and the development of the regulatory environment which favors investment whilst ensuring that adequate social measures are taken to ensure that less privileged parts of society are also able to benefit.

The purpose of this Memorandum of Understanding is to extend co-operation between the Parties in the area of the Information Society with the objective of speeding up the provision of services in Ukraine. The Memorandum of Understanding allows for improved co-operation in policy making, co-operation in the development of compatible legislation and the establishment of the conditions for a market economy for Information Society services.

3. The Parties agree as follows:

3.1 The Parties agree to co-operate further in the area of Research and Development, especially within the Information Society Technologies program of the Fifth Framework Program of the European Union and agree to exchange letters to formalize this.

3.2 The Ukrainian Party confirms its intention to develop an e-Ukraine program responding to the needs of the Ukrainian society, to stimulate the development of Information Society services in Ukraine. The Directorate General for the Information Society will provide advice based on the experience gained in the e-Europe program and will give the opportunity to Ukraine to participate in related events whenever this is feasible.

3.3 The Parties agree to exchange information about frequency policy. Ukraine confirms its intention to follow the compilation of the European table of allocations and to take it into account in their planning of national allocations.

3.4 The Parties agree to exchange information on third generation mobile services in the fields of licensing, standards and spectrum planning.

3.5 The Parties agree to encourage co-operation on the development of electronic commerce services and especially aiming at their inter-operability.

3.6 The Directorate General for the Information Society will provide advice, in response to requests, on Information Society policies developed in Ukraine and the Commission services will consider providing expert and technical assistance according to existing procedures and regulations.
